DOES MEDIATION AFFECT LITIGATING LAWYERS?

Recently I attended - DISTRICT LEGAL AID SERVICE, PUNE - MEDIATION AWARENESS CAMP

These are some of the points shared by speakers in this program -
✔️Mediation - A process in which a mediator (3rd party) has to create an environment that will open up parties to discuss, negotiate and mutually come to a conclusion.
✔️Here, Parties settle their disputes outside the court, on their own. But still, they need lawyers to represent their side with accurate legal provisions and documents to corroborate their statements. 💯 Hence lawyers in fact have a greater role to play during mediation as here they themselves have to deal with communication barriers or the ego of the parties if any.

✔️Lawyers shall not misuse Order 21 CPC to unnecessarily extend the trial period. Actually more than Judges, Lawyers are in the position to assist litigants and work for society as the sky's the limit ✨ for them, unlike judges who are in a way restricted by substantive and procedural laws.

✔️Judges are better mediators as they know how to analyze the demeanor of the litigants and remain unbiased while listening to both sides. ☑️
