Backups can also be illegal because of a format switch. Cloning a disc to create an archival copy is (providing you do not circumvent copyright protection) fine, but dumping roms is kinda maybe not. For this to be okay, you would need a blank switch game cart and a way to copy the game one to one. This is an area where copyright law has seriously been lagging behind. There was this USB device that let you play your game boy games on PC, but it had to copy the game into RAM, and that format switch was enough to make it illegal in the eyes of the law. Until outdated laws are amended, this will always be a legal grey area, and not one favourable to us consumers. If I had it my way, just owning my scratched ass copy of SADX for PC would constitute grounds to download it, I payed for it, it's infinitely replicable, it'd be no different than if I had made an archival copy, but that is still illegal. The law as it stands and is enforced is in no way comparable to the spirit of the law.
